Terms of Service

These Terms of Service govern your access to and use of LocalPersonas, a software service that helps franchise systems and multi-location businesses test advertising copy, creative assets, and messaging strategies through AI-powered audience simulations, and that generates automated performance reports from connected advertising accounts.

By creating an account, accessing the platform, or using any feature of the service, you agree to these Terms. If you do not agree, you may not use LocalPersonas.

LocalPersonas provides tools for generating company personas, digital twins, simulated customer feedback, campaign reports, and related planning insights. For franchise and multi-location customers, it also provides organization management, team invitations, connections to Meta and Google advertising accounts, and scheduled AI-generated performance reports. The service is intended to assist business decision-making and does not guarantee campaign performance, cost savings, revenue, or advertising outcomes.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate registration information and keep it reasonably current.

You may not share accounts in a way that violates your plan, impersonate another person or business, or attempt to access systems, data, or accounts you are not authorized to use.

LocalPersonas supports shared organizations in which a franchisor invites franchisees as members. If you create or administer an organization, you represent that you are authorized to do so on behalf of your business and to invite the people you add. If you accept an invitation to join an organization, you understand that certain information may be shared with that organization's administrators as described in our Privacy Policy, subject to the visibility and management controls available to each member.

Roles and permissions within an organization (such as who may view or manage a member's connected accounts and reports) are governed by the settings in the product and any separate agreement between you and your franchise network.

You may connect Meta (Facebook / Instagram) and Google Ads accounts so the service can retrieve advertising metrics and generate reports. By connecting an account, you represent that you are authorized to access it and to grant LocalPersonas access, and you agree to comply with the applicable Meta and Google platform terms and policies.

We access connected accounts only to provide the reporting features you request. You may disconnect an account at any time, which revokes our stored access and stops further data retrieval.

Some features may require a paid subscription. Paid plans renew according to the billing interval presented at purchase unless canceled in accordance with the applicable billing flow. Fees are non-refundable except where required by law.

We may change pricing, packaging, or feature limits prospectively. Any changes will apply to future billing periods and will not retroactively alter services already paid for.

You agree not to use the service to:

create unlawful, misleading, abusive, defamatory, infringing, discriminatory, or harmful content; upload malicious code; interfere with the platform; reverse engineer the service; scrape data at scale; bypass usage limits; or violate applicable marketing, advertising, privacy, or consumer protection laws.

You are solely responsible for the legality and appropriateness of all content, assets, URLs, prompts, and campaign materials you submit.

LocalPersonas and its software, branding, workflows, reports, and platform features are owned by LocalPersonas or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes.

You retain ownership of the information and content you submit. You grant us the rights necessary to host, process, analyze, store, and display that content for operating, securing, supporting, and improving the service.

The service uses automation and AI systems to generate persona simulations, recommendations, and reports. AI outputs may be incomplete, subjective, or inaccurate and should be reviewed by a human before use in live campaigns.

You are responsible for how you interpret and use AI-generated outputs, and for any business, legal, or marketing decisions made based on them.

You may stop using the service at any time. We may suspend or terminate your access if you violate these Terms, misuse the platform, create legal or security risk, or if continued access would harm the service or other users.

To the fullest extent permitted by law, LocalPersonas is provided on an “as is” and “as available” basis without warranties of any kind. We do not guarantee uninterrupted availability, error-free functionality, or that outputs will be accurate, profitable, or fit for a particular purpose.

To the fullest extent permitted by law, LocalPersonas and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, goodwill, business opportunity, or advertising performance arising out of your use of the service.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising from these Terms or the service will be resolved in the state or federal courts located in Travis County, Texas.
